The mayor of São Paulo, Ricardo Nunes, edited a decree last Tuesday (13) changing some rules for transport by applications in the city of São Paulo. Now cars can have up to ten years of manufacture, not just eight, and may be licensed in the driver’s county of residence. The changes went into effect on the same day. Among the new rules are: – Prove the issuance and maintenance of the Vehicle Registration and Licensing Certificate (CRLV) in the Municipality of São Paulo, if the holder is a legal entity, or in the municipality of residence, if the holder is a natural person; – Carry out a vehicle inspection and technical inspection, according to the parameters and frequency defined by the Municipal Road Use Committee – CMUV; – Operate a motor vehicle with a maximum of 10 (ten) years of manufacture. In a note, the Brazilian Association of Mobility and Technology (Amobitec), which represents 99 and also Uber, both transport applications, reported that companies linked to the association act in accordance with the legislation of the city of São Paulo and understand that The expansion of the vehicle age is welcome, as it adapts to the economic situation of the partner drivers. “Other points of the municipal decree, however, will be subject to analysis in relation to federal legislation and consolidated understandings in the Judiciary”, concluded the note. Uber explained that the new decree extending the vehicle age in São Paulo brings important advances because it takes into account the economic reality and the aging of the average age of the Brazilian fleet. “The new limit will benefit hundreds of partner drivers who generate income with the platform and who will be able to continue driving with their vehicles”. Uber stated that the inspection is not provided for in Federal Law 13,640, which regulates the applications “and which guides municipal regulations, according to an understanding consolidated by the Federal Supreme Court (STF). Therefore, in 2019, this vehicle inspection requirement had already been suspended in the municipality by court decision. Regarding the proposal to restrict the provision of private transport services to vehicles from certain municipalities, the decree presents a setback for regulation in São Paulo, which is also not provided for in Federal Law and intends not only to prevent more people from generating income, but also to disintegrate the mobility of troubled regions like São Paulo. The proposal to restrict license plates has been suspended by the courts since 2018,” concluded the Uber note. CPI of Applications This past Monday (12), the CPI (Parliamentary Commission of Inquiry) of Applications unanimously approved the final report of the investigations and ended the work. All documentation, with over a thousand pages, brings a series of recommendations, in particular the need to review the regulation of passenger transport services and a new rule for delivery services in the capital, better working conditions and the urgency of social security legislation aimed at these categories. According to the City Council, to ensure that the information obtained during the investigations has reach, the recommendations must be sent to the National Congress, where discussions on transport and delivery applications take place at the federal level; to the City of São Paulo (Executive Power), for the municipality to audit the payment of the public price per kilometer traveled by transport apps since 2016, one of the main points addressed during the investigations and whose collection forecast, for this year, is around BRL 240 million; to the State Public Ministry; to labor justice; to transport and delivery application companies; representative bodies and labor bodies. Regarding the CPI, 99 informed that it will analyze the final report of the Applications CPI. “The company points out that it fully complies with current legislation and is rigorously up to date with payments of all taxes, as has been proven numerous times before the Commission. As occurred during the entire operation of the CPI, 99 remains available to provide any clarifications that may be necessary and to discuss with the authorities any improvements in the regulation of individual private passenger transport through applications that result in better conditions for passengers, drivers and the cities in which it operates”, said the note sent to Agência Brasil. As for the CPI, Uber said in a note: “After almost two years since it was introduced, the CPI of Applications ends with empty conclusions, based on an apparent dubious political will to denounce, without foundation, companies that contribute to São Paulo and that facilitate the lives of people who move and generate income in the city. Over all these months, the only highlights achieved by the councilors involved in the commission were issues unrelated to it: an investigation carried out by the Public Ministry of one of the councilors for the misuse of public funds from his office and the sad racist speech of another congressman during one of the sessions, which culminated in different investigations and in a process of impeachment that is still ongoing. We, the people of São Paulo, are the losers. Uber reinforces that it complies with Brazilian legislation, and that all payments due to the municipality of São Paulo have been and are made to the City Hall in accordance with the regulation”, highlighted the note sent to Agência Brasil.
