The Attorney General’s Office (PGR) sent yesterday (28) to the Federal Supreme Court (STF) an opinion to maintain the tenure of 11 federal deputies elected on February 1st. The document is signed by deputy attorney Carlos Frederico Santos and was motivated by a petition made to the Supreme Court by lawyers from the Prerogativas Group. Members of the entity accuse deputies elected in 2022 of inciting the anti-democratic acts of January 8 through posts on social networks. The request involves deputies Dr. Luiz Ovando (PP-MS), Marcos Pollon (PL-MS), Rodolfo Nogueira (PL-MS), João Henrique Catan (PL-MS), Rafael Tavares (PRTB-MS), Carlos Jordy (PL-RJ), Silvia Waiãpi (PL-AP), André Fernandes (PL-CE), Nikolas Ferreira (PL-MG), Sargento Rodrigues (PL-MG) and Walber Virgolino (PL-PB). In the opinion, the sub-prosecutor of the Republic states that the request must be rejected by Minister Alexandre de Moraes, rapporteur of the petition, due to lack of legal legitimacy to claim the suspension of the parliamentary inauguration. “It cannot be forgotten that political parties, coalitions, candidates and the Public Prosecutor’s Office are entitled to file an appeal. Therefore, the applicants do not have the legitimacy to post any appeal against diplomacy”, stated Santos. The inauguration of the elected deputies and senators will take place on Wednesday (1st) and will have reinforced security. The Legislative Police detected several risks during the ceremony, such as “invasion into unauthorized areas, hostage taking, the presence of an active shooter, threat of explosives and even sabotage in critical infrastructures”.
