Minister Alexandre de Moraes, of the Federal Supreme Court (STF), decided, this Monday (3), to maintain the arrest of former federal deputy Daniel Silveira (PTB-RJ). Moraes denied the request for release made by the defense of the former deputy, maintained the blocking of his social networks and rejected the return of fines for non-compliance with precautionary measures. Lawyers defended the release of Daniel Silveira based on the decree in which, in May last year, then-president Jair Bolsonaro granted constitutional grace to the sentence of the former federal deputy. The decree was published on April 21, one day after the parliamentarian was sentenced by the Supreme Court to eight years and nine months in prison for the crimes of trying to prevent the free exercise of Powers and coercion in the course of the process. In the decision, Moraes said that the legality of the decree will be analyzed by the plenary of the STF on the 13th of this month. Thus, Silveira will remain imprisoned until the decision of the Court. “While there is no such analysis and the decree of the extinction of punishment by the Judiciary, the present criminal action will proceed normally, including with regard to the observance of the imprisonment imposed on the defendant Daniel Silveira, in addition to the other constriction measures enacted”, concluded the minister.
