The Federal Justice of Bahia determined that the Union and the National Institute of Colonization and Agrarian Reform (Incra) carry out the titling of the territory of the Quilombola Community of Sambaíba, in the municipality of Riacho de Santana. According to the decision, the Union and Incra must present a schedule for carrying out all pending steps until the territory is titled within 30 days. Within the same period, the bodies must also define the budget forecast and the contribution of resources for effective compliance with the period established in the planning, which must occur within 36 months. The process relating to the titling of the quilombola territory began in 2005, according to information from the Federal Public Ministry (MPF). However, 18 years later, Incra “still would not even have completed the process of land regularization in that community”, one of the first stages, said prosecutor Ramiro Rockenbach da Silva Matos, in charge of the case. The administrative process involves several stages, such as identification, recognition, delimitation, demarcation and titling of the property. In court, the MPF argued that the delay, in this case, “far exceeds a duration considered reasonable, causing serious damage from the point of view of maintaining its culture and traditional uses”. “The request covers the realization of basic social rights, notably related to housing and the protection of the culture of a historical community in the country, not fitting its denial under the allegation that the resources of the public power would be so scarce that it would make the granting unfeasible ”, says the court ruling.
