The Palmares Cultural Foundation revoked the 2022 decree of the Jair Bolsonaro government, which made more stringent the rules for issuing self-definition certificates for quilombola communities. At the same time, the body linked to the Ministry of Culture restored the 2007 ordinance of the second government of Luiz Inácio Lula da Silva, which established the General Registry of Remnants of Quilombo Communities, also known as Terras de Preto, Comunidades Negras, Mocambos, Quilombos, between others. “Remnants of quilombo communities are considered to be racial ethnic groups, according to self-attribution criteria, with their own historical trajectory, endowed with specific territorial relations, with presumption of black ancestry related to forms of resistance to the historical oppression suffered”, says the ordinance that returns to force this Thursday (6). The declaration of self-definition of ethnic identity, which composes the cadastre, is necessary for the procedures of identification, recognition, delimitation, demarcation and titling of lands occupied by remnants of quilombo communities. The theme is regulated by Decree nº 4.887/2003. Ordinance No. 75/2023, which updates the process for issuing certificates, was published today in the Official Gazette. According to the text, the Palmares Cultural Foundation also set up a working group to prepare a new normative act for the General Registry of Quilombos Remnants and establish the procedures for issuing the Certificate of Self-Definition at the Palmares Cultural Foundation. The group will last a maximum of 90 days to carry out the work, which may be extended only once.
