The plenary of the Superior Electoral Court (TSE) unanimously denied a request made by the defense of former President Jair Bolsonaro for Minister Alexandre de Moraes to be removed from a process involving the former representative. The appeal was judged in virtual plenary, in an extraordinary session closed at 23:59 yesterday (10). The request was based on a gesture made by Moraes during the trial of a lawsuit involving Bolsonaro’s lives, on September 27 last year, in the presidential campaign in which he was trying to be re-elected. On the occasion, Moraes made a sticking gesture with his finger, which was interpreted by the defense as a manifestation of “animosity” with Bolsonaro and of “personal interest” in the process, which is why they asked for the suspicion of the minister, who is president of the TSE. At the time, several press vehicles reported that the gesture had nothing to do with the trial, but had been directed at an advisor who had taken time to complete a task requested by Moraes. Minister Ricardo Lewandowski had previously denied the request for suspicion, stating that “the objective of the present action is only to create a political fact with the reprehensible purpose of disrupting the electoral process”. Then, the case ended up in the cabinet of Minister Nunes Marques, who used the same words to vote for the rejection of the request. He was followed by the other ministers who participated in the trial. As he was the target of the request, Moraes was prevented from voting.
