Treasury asks for an end to the suspension of a decision favorable to the Union’s coffers

The Attorney General of the National Treasury (PGFN) asked, this Thursday (27), the minister of the Federal Supreme Court (STF) André Mendonça to reconsider the decision that suspended the result of the trial that could increase the federal government’s collection by up to BRL 90 billion. This Wednesday (26), the minister suspended the decision of the Superior Court of Justice (STJ) that would allow the Union to charge Corporate Income Tax (IRPJ) – that is, companies – and Social Contribution on Net Income (CSLL). ) on tax incentives related to the Tax on Circulation of Goods and Services (ICMS). The STJ’s decision favors the federal government, but it remains suspended. After the result of the judgment in the Court, the Minister of Finance, Fernando Haddad, praised the decision and said that the fiscal adjustment “cannot be made on top of the worker”. In the petition, the PGFN contested the legitimacy of the Brazilian Agribusiness Association (ABAG) to act in the STF and stated that the matter suspended by Mendonça is unrelated to the case judged by the STJ. “The granting of this injunction delays the outcome of more than 5,438 lawsuits, whose economic and financial impact is extremely high, as has been widely publicized in the press. The issue that is on the agenda of the STJ is one of the most relevant for the Brazilian State, either because companies are misinterpreting the infraconstitutional legislation and recording tax credits not provided for by law”, argued the attorney general.
