The State Attorney General’s Office (PGE-RJ) appealed this Saturday (29) against the court’s decision that canceled the holding of the contest test to fill 800 vacancies in the Military Fire Department, scheduled for this Sunday (30)”. In a decision this Friday, the Justice of Rio de Janeiro determined the suspension of the test to fill soldier positions in the Military Fire Department. The measure was taken because the public notice required candidates to submit an HIV serology test. The decision also determines that the State of Rio de Janeiro and the Social Institute for Universal Development (IUDS), organizer of the selection, reopen the contest registrations. Judge Mônica Feldman de Mattos of the 6th Chamber of Public Law of the Court of Justice, determined the suspension of this Sunday’s test and the reopening of registrations for a minimum period of five days, suppressing the requirement to deliver the serology test for HIV. “The conduct of the administration proves to be unreasonable and segregating, in dissonance with the principle of the dignity of the human person, and may invalidate the aforementioned public notice”, highlights the magistrate in the decision. Public civil action The decisions originated from a public civil action that the Public Ministry of the State of Rio de Janeiro (MPRJ) filed for the State of Rio and the IUDS to suspend the requirement of the serology test for HIV (Human Immunodeficiency Virus), contained in the public notice of the contest, and for the test to be suspended and registration reopened, since candidates could have stopped enrolling due to the criterion. According to the document, the delivery of the exam results, as a mandatory requirement for the admission of candidates to the public positions in question, is a discriminatory act and, therefore, unconstitutional.
