The Public Defender’s Office of the state of São Paulo and the non-governmental organization Conectas Human Rights have questioned the performance of the Metropolitan Civil Guard (GCM) of São Paulo in the Cracolândia region, in the center of the city of São Paulo. The most recent episode is related to a man who was unconscious after being approached by guards. This week, the TV Brasil team caught a man unconscious after being hanged by GCM agents. According to the city hall, the team was accompanying, on Monday (8), a janitorial action, when it was assaulted and acted to contain the man. The city hall also informed that the man was taken to the Emergency Room in Barra Funda, “as he claimed to have heart problems and chest pains. At the health unit, he was attended to, medicated and released ”. Subsequently, he was taken to the 77th Police District, where the occurrence was registered. “Once again we are seeing GCM on the front lines of Cracolândia, which has already caused numerous problems. This history of civil guard action in the territory of Luz is even in court, in a Public Civil Action that discusses the actions that take place because of this practice”, points out Fernanda Balera, public defender and member of the Specialized Center for Citizenship and Rights Humans. In a letter sent to City Hall on April 11, the Public Defender’s Office specifically questioned the procedures in janitorial actions. “What is the justification for carrying out urban cleaning, including ‘screening’ and inspection, to be carried out by the Metropolitan Civil Guard and not by urban cleaning agents, considering that the function of the Civil Guard would be to ‘monitor the actions of janitorial, acting exclusively to safeguard the rights of workers and public agents who carry out the action and to preserve the rights of people affected by janitorial actions’ (Article 9 of the Ordinance)”, points out the text. Agência Brasil requested the Police Report from the Secretariat of Public Security (SSP) regarding the case caught by TV Brasil and is waiting for the information to be sent. There is no confirmation if he is arrested or released. His identification was also not disclosed. Unconstitutional action Lawyer Gabriel Sampaio, director of litigation and enforcement at Conectas Human Rights, repudiates the aggression and requests that the case be investigated. “The GCM does not have the competence to act as overt or repressive police, nor should it use force in such a disproportionate way as we observe in the report”, he assesses. He points out that, “when approaching people who use drugs, fundamental rights and guarantees must be respected, the proportional use of force must never be used, and a body like the GCM should never be used for this type of approach”. Sampaio adds that the Constitution attributes to the GCM the role of protecting public property and does not authorize “this type of use of force”. Investigation The Municipal Secretariat for Urban Security said, by means of a note, that “the cited occurrence will be duly investigated by the Internal Affairs of the Metropolitan Civil Guard” and that “it does not condone any inappropriate conduct”. “SMSU is committed to ensuring that GCM’s actions are always guided by respect for human rights and people’s dignity. This precept is essential and must be followed by all Guard agents”, points out the body. The city hall also said that the role of the guard is guided by Law No. 13530, of March 14, 2003, which institutes the Disciplinary Regulations for Servers of the GCM Professionals.
