The model Bruno Fernandes Moreira Krupp will be judged by the 4th Jury Court of the Capital. He was denounced for the death of João Gabriel Cardim Guimarães, aged 16, who was run over on July 30 last year, on Avenida Lúcio Costa, in Barra da Tijuca. As he has been released since March, by decision of the Superior Court of Justice (STJ), he will be able to appeal freely. The model goes to a popular jury, answering for intentional homicide, when there is the intention to kill. In the decision, Judge Gustavo Gomes Kalil stated that the disqualification theses presented by Bruno’s defense must be evaluated by the Sentencing Council as it is the constitutional competence of the Jury. “Thus, the right of society to assess and decide on the fact through the jury body prevails”. The magistrate highlighted, in another excerpt, the defendant’s testimony during the instruction phase of the process. “In November last year, Bruno admitted that he was riding his motorcycle at more than 100 km/h, above the 60 km/h required at the site, but that he respected the signs. He stated that, when he saw the pedestrians ahead, he calculated that there would be time and space to pass without hitting them, trying to throw the motorcycle to the right, but that he hit João as soon as he moved to try to avoid the impact”. Legal advisor Marina Cardim Lima, mother of João Gabriel and assistant to the prosecution in the process, also testified at the session. She said she was leaving a party with her son and suggested they go for a walk on the beach. “As she crossed, she noticed that the cars were parked in the distance and that, then, she saw a figure pass and drag João Gabriel. She went to him to help him and started screaming for help. Marina said that João was lucid, that he even talked and prayed with his son, who complained of pain in his leg, but that he still hadn’t noticed that his leg had been amputated immediately with the force of the impact, “she said.
