About 5,000 people participated in the public act in defense of the Social Service of Commerce (Sesc) and the National Service of Commercial Learning (Senac) held, this Tuesday afternoon (16), in Cinelândia, the stage for demonstrations in downtown From Rio. The so-called S-Day, which took place simultaneously in other states, brought together employees of the Commerce System, users, students, teachers, artists and athletes opposed to the diversion of 5% of Sesc and Senac resources destined to the Brazilian Agency for the International Promotion of Tourism ( Embratur). According to the president of the Federation of Commerce of Rio (Fecomercio RJ), Antonio Queiroz Junior “the work that Sesc and Senac do, nobody does. The S System uses its resources broadly and efficiently in culture, leisure, health, education and many other areas. The 5% deviation seriously impacts our activities. Units can be closed, jobs lost and thousands of services interrupted”, he evaluated. The act had the support of singers Sandra Sá and Dudu Nobre, in addition to volleyball athletes, such as Talita Antunes and Juciely Silva. During the demonstration, signatures were collected for the petition against the diversion of resources. The document already has more than 650 thousand adhesions. The demonstration against the diversion of 5% of Sesc and Senac resources, approved in the Chamber of Deputies, through articles 11 and 12, included in the Conversion Law Project (PLV) 09/2023, scheduled to go to the vote in Federal Senate, this Wednesday (17). According to Fecomercio RJ, if the devices come into force, the activities of Sesc and Senac may be closed in more than 100 Brazilian cities and more than R$ 260 million will no longer be invested in free services, such as clinical and dental exams , for example. With the cut of funds in the S System, more than 3,600 workers may be laid off, a reduction of 2.6 million kilograms of food distributed by the Mesa Brasil Program, the closure of 7,700 enrollments in basic education and 31,000 in vocational education, among other losses that will be directly suffered by the population served. Unconstitutional By law, all Sesc and Senac resources must be used to finance social welfare programs for commerce workers and their families, in addition to creating and managing commercial learning schools and practical, continuing education or specialization courses for employees of trade. If it comes into force, the new legislation will violate numerous decisions of the Federal Supreme Court (STF) that determine that these funds are not public, since the contributions of large entrepreneurs in the tertiary sector must be destined exclusively for these purposes. Even without contributing, micro and small companies also benefit from the qualification of employees and the improvement of living conditions for the population in general. Misconception The amount indicated by Embratur as the supposed surplus of Sesc and Senac is already committed to maintenance work or the start of new units throughout the country. The 2023 budget was agreed upon by the Fiscal Council of Sesc and Senac, formed by seven entities, four of which are leaders of the federal government, two of business entities and one representative of the working class. The resources were pledged for a previously determined use and known by all, including the government. Mobilization Last week, two letters were addressed by confederations and trade union centrals to senators – one forwarded by workers and another by businessmen – stating that the redirection of values will harm millions of free services offered to the population in the areas of health, education, assistance, culture , leisure and professionalization. Appeal The presidents of six trade union centrals and two of federations sign a note in which they ask the Federal Senate to reject a project that transfers funds from Sesc and Senac to Embratur. The joint note says that the union centrals request that the Federal Senate reject articles 11 and 12 of PLV 9/2023, inserted by the Chamber of Deputies in MPV 1147/2022, which redirect to Embratur 5% of the contributions passed on to Sesc and to Senac. The document states that “this undue and unfair redirection will harm millions of services offered to the population in the areas of health, education, assistance, culture, leisure and professionalization. It is an amendment alien to the central object, which withdraws resources from a system that serves thousands of workers across the country”. In another section, the note adds that “the inclusion of these two articles violates the guarantees provided by the legislation (Article 240) for the maintenance of autonomous social services affected by the proposal, with regard to their purposes and compulsory resources. It is precisely these resources that allow Sesc and Senac to carry out their attributions”.
