Supreme Court extinguishes sentence of ex-deputy Paulo Maluf

Minister Edson Fachin, of the Federal Supreme Court (STF), declared today (16) extinct the conviction of former federal deputy Paulo Maluf to ten years and six months in prison for money laundering and electoral ideological falsehood. The minister’s decision took into account the Christmas pardon signed last year by then-President Jair Bolsonaro. In Fachin’s understanding, Maluf, who is 92 years old and free, has served more than a third of his sentence and meets the legal requirements to benefit from the pardon. “The reasons of convenience and the principles of criminal policy that motivated the edition of the act of clemency do not mean that the State Judge is not assigned the task of, when interpreting the norm edited by the President of the Republic, to investigate its meaning and scope, with in order to delimit, with precision, the extension of the decree”, wrote the minister. Last month, the Public Ministry of São Paulo announced the return of more than R$ 150 million to the city of São Paulo as part of an agreement involving the family of Paulo Maluf. According to the agency, part of the money embezzled by Maluf in the 1990s, when he was mayor, was used to buy shares in Eucatex, a company that belongs to the family.
