The Federal Regional Court of the 1st Region (TRF1) overturned this Thursday (25), in Brasília, the decision that annulled the inauguration of the president of the Brazilian Trade and Investment Promotion Agency (Apex), Jorge Viana. The decision was handed down by federal judge Marcos Augusto de Souza and responded to an appeal filed by the Attorney General’s Office (AGU). For the magistrate, Vianna can remain in office because the Apex statute allows several ways to prove aptitude to command the agency, among them, advanced English certificate, work or study experience outside the country or minimum experience of two years in Brazil using the language in the performance of functions. Documents “The federal entity collects from the present records documents that prove compliance with the last two alternative requirements – attesting that the nominee held the position of member (full and alternate) of the Committee on Foreign Affairs and National Defense in the period of 02/22/2011 on 12/21/2018, in addition to having participated in several missions abroad and having integrated several commissions and groups operating at the international level”, decided the judge. On Monday (22), the Federal Court, in Brasília, ordered the annulment of Jorge Viana’s tenure at the Apex. The decision was taken by Judge Diana Vanderlei, of the 5th Federal Court in the Federal District. The magistrate accepted a preliminary injunction filed by Senator Flávio Bolsonaro (PL-RJ). According to the judge, Apex changed internal rules to allow the former senator to take over as head of the agency without proving fluency in English, a requirement that was essential to lead the agency before the changes.
