The Superior Electoral Court (TSE) decided today (25) to apply, unanimously, a new fine to deputy Carla Zambelli (PL-SP) for disseminating false information or misinformation about the electoral process. This time, the amount to be paid is the maximum foreseen in the electoral norms, of R$ 30 thousand. The parliamentarian was tried for a video, published on her YouTube channel before last year’s general election, in which she claims to have notified the competent authorities to investigate a video according to which the electronic voting machines were being “manipulated” by people linked to the PT within an ABC Paulista union. Before the deputy’s speech, the content of the video, which went viral on social networks and messaging apps, was denied by the Regional Electoral Court (TRE-DF), which said it was false information. “I found notorious bad faith on the part of the person represented, who, after a note from the Regional Electoral Court of São Paulo, freely and consciously produced and disseminated the video”, said Gonçalves, rapporteur of the representation against the deputy. He justified the maximum amount of the fine against “the gravity of the unfounded accusations against the fairness of the electoral process, without any support in the world of facts”. In defense of the deputy, lawyer Thiago Rocha maintained during the trial that she did not share any false or out of context information. “There was no suggestion of fraud, there was only the statement that, due to the virality of that video, the deputy asked for information to find out if there was any type of illegality or not”, said the defender. Last week, the TSE had already fined Zambelli R$10,000 for another case of spreading false news, this time involving President Luiz Inácio Lula da Silva.
