The Federal Supreme Court (STF) decided to annul the conviction of former federal deputy Eduardo Cunha to 15 years and 11 months for corruption and money laundering in one of the Lava Jato Operation processes. By 3 votes to 2, the decision was taken in a virtual session of the Second Panel of the Court, a modality in which ministers enter votes in the electronic system and there is no in-person voting. Most justices accepted the arguments presented by Cunha’s defense and understood that the process should have been conducted by the Electoral Justice, and not by the Federal Justice in Curitiba. The case involves the accusation that Cunha would have received bribes from Petrobras contracts for the construction of drillships. In 2021, in another decision on jurisdiction, the Second Panel also sent a conviction against Cunha to the Electoral Court. In that case, the former parliamentarian was sentenced to 15 years and four months in prison by the then judge Sérgio Moro for the crimes of corruption, money laundering and currency evasion. Defense In a note, the defense of the former deputy declared that the decision of the STF confirms the “persecution against Cunha” “The decision of the Supreme Court did justice and confirms what the defense maintains since the beginning of the process and that is now becoming clear to all the country: Eduardo Cunha, as well as countless other defendants, was the victim of an abusive, partial and illegal persecution process and tried by a manifestly incompetent body”, said the defense.
