Minister Dias Toffoli, of the Federal Supreme Court (STF), denied this Wednesday (7) the request of former federal deputy Deltan Dallagnol (Pode-PR) to suspend the decision that revoked his mandate. Last month, unanimously, the Superior Electoral Court (TSE) understood that the former parliamentarian tried to circumvent the Clean Record Law by asking for dismissal from the position of public prosecutor during the course of disciplinary proceedings opened to determine his conduct in conducting the Operation Lava Jato processes. Toffoli denied the request on the grounds that there were no illegalities in the TSE’s decision. “From what is in the judgment handed down by the TSE, there is no flagrant illegality, abuse of power or teratology. On the contrary, the judgment in question is duly substantiated, and the conviction formed, in particular, in precedent of the Supreme Court itself is justified”, wrote the minister. TSE The TSE’s decision followed the understanding of the case’s rapporteur, Minister Benedito Gonçalves. During the trial, the minister said that the former prosecutor requested dismissal from the Federal Public Ministry (MPF) on November 3, 2021, when he had already been sentenced by the National Council of the Public Ministry (CNMP) to the penalty of censorship and warning. and still had 15 different procedures in procedures unfavorable to him in the body. Deltan Dallagnol’s defense claimed that he was fit to run for election. Lawyer Leandro Rosa also stated that the request for dismissal was made after the CNMP provided a certificate confirming that there were no ongoing proceedings against him.
