The Federal Supreme Court (STF) recorded, this Friday (9), a score of 5 votes to 2 to confirm that the vacancy of former deputy Deltan Dallagnol in the Chamber of Deputies will be occupied by Luiz Carlos Hauly (Podemos-PR), legend substitute. The trial runs until 23:59. The votes of three ministers are missing. The Court is deciding whether to maintain the injunction issued by Minister Dias Toffoli, who, on Wednesday (7), accepted an appeal filed by Podemos to overturn the recount of votes made by the Regional Electoral Court (TRE) of Paraná after the decision of the Superior Court Eleitoral (TSE) that revoked Deltan’s mandate. By the decision of Toffoli, who is the rapporteur of the case, the vacancy of the former prosecutor of Operation Lava Jato will be with Hauly, and not with the candidate Itamar Paim (PL-PR), who was even declared by the TRE as a replacement for Deltan. Toffoli agreed with Podemos and understood that the seat should go to the party’s alternate, who was passed over by the TRE for not having achieved a minimum of 10% of the state’s electoral quotient, estimated at 20,000 votes. According to the understanding, Hauly, who obtained 11,000 votes in the 2022 election, must be sworn in because it is not necessary to obtain a minimum number of votes to take Dallagnol’s vacancy. The case is definitively analyzed by the virtual plenary of the Court, a modality in which the justices enter the votes in the electronic system and there is no in-person deliberation. In addition to Toffoli, ministers Alexandre de Moraes, Gilmar Mendes, André Mendonça, Cármen Lúcia also voted to confirm Hauly as the former deputy’s replacement. Edson Fachin and Luiz Fux disagreed and understood that the vacancy should remain with the PL.
