The Minister of Justice, Flávio Dino, said, this Monday (19), that there is no doubt that there was an attempted coup d’état in the country in the period between October 31, 2022 and January 8, 2023. it was made in Rio de Janeiro, during an announcement of investments in public security in the state. “There is no doubt that Brazil, between October 31, 2022 and January 8, 2023, experienced an attempted coup d’état. This is very serious, very serious, and must be underlined very clearly so that it does not happen again”, said the minister. “There was a criminal plot trying to rig the election result.” According to him, this has been shown in investigations by the Federal Police (PF), the Public Ministry and parliamentarians. “We have more than 1,300 criminal actions already filed, pending in various Brazilian courts, not just the Supreme Court, which shows the breadth of this criminal articulation.” Dino lamented the fact that, according to evidence obtained by the Federal Police from seized material, a small group of high-ranking active-duty military personnel had been involved in the articulation of a coup d’état. “Were there civilians? Yes. Were people of good faith being involved in some kind of authoritarian and extremist seductive discourse? Yes. But there were also political leaders, military leaders, leaders of civil and military power, who were unduly participating in an articulation to tear up the Constitution, trample democracy and violate the rights of all Brazilians who elected this government that is here.” The minister also stated that the Federal Police will investigate the case of the evangelical pastor who asked God to break the jaw of the President of the Republic, Luiz Inácio Lula da Silva. “Freedom of expression in Brazil takes place under the terms of the law. Everyone has freedom of belief, no doubt. But freedom of belief does not involve the criminal practice that is in Article 286 of the Penal Code, which is called incitement to crime, ”he said. Zanin At a press conference in Rio, Dino also defended the appointment of lawyer Cristiano Zanin to a vacancy on the Federal Supreme Court (STF). According to him, there is no problem with the fact that Zanin is a person close to President Lula, whom he defended in the Lava Jato Operation processes. “We have, in the world, a variety of systems for appointing ministers to the supreme courts and constitutional courts, but they all have something in common. No appointing authority appoints a person who is your enemy, your political opponent,” said Dino. “The Constitution sets the requirements: notable legal knowledge and unblemished reputation. Until today, almost 30 days after President Lula was nominated, no concrete facts have emerged that say that in the future, God willing, Minister Zanin does not have notable legal knowledge or an unblemished reputation.” Marielle Flávio Dino also spoke about the progress of investigations that seek to find out who ordered the murder of councilor Marielle Franco. According to him, the case is an “absolute priority” for the Federal Police in Rio de Janeiro. “We have, practically every 15 days, a meeting to discuss the progress of the investigations. After five years [do crime], all the collection of evidence, all the reconstitution of the case, that is possible to be done is being done. We currently have positive prospects. We strongly believe in this integrated work between the federal and state spheres and we are working on it. Of course, there are confidential and reserved details of the investigation, but I continue to believe in the solution of this case, which is important for Brazil, not just for Rio de Janeiro.”
