The Ministry of Finance published, this Wednesday (28), the requirements, conditions and procedures for joining the Emergency Debt Renegotiation Program for Delinquent Individuals (Desenrola Brasil). The rules were detailed in an ordinance published in the Federal Official Gazette. Range 1 The ordinance establishes two ranges for joining the program. Range 1 is for those with a monthly income of up to two minimum wages, which currently amounts to R$ 2,640, and also for debtors enrolled in the Single Registry for Social Programs of the Federal Government (CadÚnico). For this group, the debt cannot exceed R$ 5 thousand. It is also necessary to have been included in the register of defaulters in the period between January 1, 2019 and December 31, 2022. All types of debts can be renegotiated, including consumption ones, such as water, electricity, telephone, retail and bank debts and as well as payroll loans. Debts with real guarantees or those relating to rural credit, property financing or operations such as funding cannot be renegotiated by the program (attracting investments for companies). Tier 1 people will only be able to join Desenrola Brasil through the gov.br digital platform, with silver or gold certificates, where they will be able to choose the financial agent, the debts for renegotiation and the form of installment. Tier 2 Tier 2 serves debtors with a monthly income of up to R$ 20,000, who can join the program both through the gov.br platform and through channels indicated by financial agents. They will be able to settle the debts in installments, starting from 12 installments. It is also necessary to have been included in the defaulter register by December 31, 2022. For this group, rural credit debts cannot be part of the program; debts that have a guarantee, equalization of interest by the Union, public entity or contribution of public resources; and debts that do not have assumed credit risk. Creditor Financial agents and creditors who want to participate need to register on the program’s platform and on the Operations Guarantee Fund. You can also use a technological solution to exchange information with the program’s platform, through specific files. The information to be provided is related to the active records of defaulters in the Desenrola Brasil profile, such as the contract number, date of denial and entry in the default register, in addition to the three initial digits of the debtor’s CPF number. All program operations are exempt from IOF and will work through an auction between creditors who will offer discounts on their credits included in the lots. Debtor registration Debtors who want to join Desenrola Brasil must access www.gov.br, click on “enter with gov.br”, fill in the CPF number to create or change the account. To increase the level of the account from bronze to silver or gold, through the application’s guidelines, or through the internet in the option to increase your level, in seals of trust. Another way to increase the level is to login with your bank account. The debtor must have the telephone number registered with the bank to receive SMS and confirm access.
