With that, this Monday (26th) becomes, informally, the world day of exchanges and the stores are full of customers, this time, to exchange Christmas gifts. The Consumer Protection Code does not oblige the store or supplier to make an exchange for reasons of taste or size, the measure only becomes mandatory if, at the time of sale, they have committed to doing so. It is therefore recommended, before purchasing the gift, that the consumer find out about the possibility and conditions for exchanging the product, for example, maintaining the label, presenting the tax coupon or exchange coupon. If the purchased product has a defect or problem, the supplier has up to 30 days to resolve it. If the repair is not carried out within this period, the consumer can choose to exchange the product, refund the money or proportional reduction of the price. If the product is essential or if, due to the extent of the defect presented, the replacement of the damaged parts compromises the fundamental characteristics of the product or reduces its value, the consumer has the right to an immediate exchange or refund of the amount paid. If the consumer has any problems making the exchange, he can look for Procon-SP to formalize his complaint. Repentance period In purchases made outside the commercial establishment, as is the case with internet purchases, the consumer may withdraw from the purchase. It is the right of repentance, which can be exercised within seven days from the date of purchase or receipt of the product. According to Procon, it is important that the consumer formalizes the withdrawal in writing and if he has already received the product, he must return it with the right to receive back the amount paid.
