The Attorney General’s Office (PGR) was in favor of maintaining the preventive detention of the former commander of the Military Police of the Federal District (PM-DF) Fábio Augusto Vieira, detained in Brasília since the last 10th. Federal Supreme Court (STF) that the former commander be released, as his detention would be unjustified. The defense added to the process images released this week that show Vieira bloodied. According to the lawyers, Vieira was wounded in the head while, together with his subordinates, he tried to prevent vandals and coup plotters from invading and destroying the Planalto Palace, the National Congress and the Federal Supreme Court (STF) building, on the 8th. At the time, Vieira still commanded the PM-DF, being responsible for, among other things, establishing the corporation’s command and employment policy and advising the district secretary of public security. Vieira’s dismissal from the command of the PM-DF was one of the first measures adopted as soon as the President of the Republic, Luiz Inácio Lula da Silva, announced federal intervention in the area of public security in the Federal District and appointed the executive secretary of the Ministry of Justice and Public Security, Ricardo Cappelli, as intervenor, on the same day 8. In the report in which he analyzes the factors that culminated in the anti-democratic attack on the Executive, Legislative and Judiciary powers, the federal intervenor pointed out that, although he was present at Praça dos Três Poderes , acting alongside other military police officers, Vieira had lost “the ability to lead his direct subordinates, since his requests for reinforcement were neither considered nor responded to promptly”. The PM-DF Corregedoria instituted six military police investigations to investigate the conduct and eventual omissions of several agents, mainly commanders and deputy commanders. Vieira was arrested by order of Minister Alexandre de Moraes, of the Federal Supreme Court (STF), at the request of the Federal Police (PF), who pointed out the omission of local authorities in controlling the acts of the 8th and the connivance of those responsible for surveillance of the central area of Brasilia with vandals and scammers. In the same decision, Moraes authorized the arrest of the former Secretary of Public Security for the Federal District, Anderson Torres. Former Minister of the Bolsonaro government, Torres was arrested on the 14th, upon landing at Brasília International Airport, coming from the United States, where he had been on vacation since the eve of the January 8 attacks. In his statement on the request for Vieira’s defense, the Deputy Attorney General of the Republic Carlos Frederico Santos, coordinator of the Strategic Group to Combat Anti-Democratic Acts, maintained that “there has been no change in the situation in fact or in law” since Minister Alexandre de Moraes authorized the precautionary arrest of the former commander. The representative of the PGR also refuted the allegations that the former commander did not participate in the planning and organization of the security operation for January 8th. For Santos, it is not “believable” that Vieira “was unaware of the seriousness of the acts that were about to happen”, so much so that, personally, he went to the scene of the facts to follow all its developments. “What we have, so far, is a criminal hypothesis that authorizes the applicant’s precautionary custody, because, although there is a need to define other responsibilities and some factual outlines, there is evidence that the applicant knew, could and should have acted”, maintains the deputy prosecutor, claiming that the former commander could and should have activated the necessary personnel to contain the criminal action. Considering the urgency of the investigation, the PGR asks Moraes to determine that the PF present, within 15 days, a partial report of the investigations, including the analysis of the material seized in previous diligences.
