The former governor of Rio Sérgio Cabral had his house arrest revoked for one of the processes he is facing. The decision of the Federal Regional Court of the 2nd Region (TRF2) was handed down this Wednesday (1st). Sentenced to a sentence of 20 years, 4 months and 21 days of imprisonment in a closed regime by the First Specialized Panel of TRF2 in the Efficiency Operation process, in November, he obtained the revocation of the preventive detention in house regime then determined by the collegiate in that process. The determination, however, does not immediately benefit Cabral, who is serving house arrest for another TRF2 decision, referring to the Calicut Operation process, in progress in the First Specialized Section. Accompanying unanimously the vote of the rapporteur, federal judge Simone Schreiber, the First Specialized Panel considered that the reasons that justified the precautionary measure established in the appeal do not persist today. The judges understood that there was an excess of custody time and that Cabral does not pose a risk to public order and the instruction of the process, which is already concluded. The understanding is in line with the decision handed down by the Federal Supreme Court (STF) in December, which determined the revocation of the former governor’s preventive detention. Under the terms of the decision, despite not remaining in prison, the former governor must wear an electronic anklet and cannot leave the country, and must deliver his passport to the first degree court, which he must also attend monthly. Cabral’s defense was sought to comment on the decision, but has not yet commented.
