The Official Gazette of the Union publishes today (6) the calendar of situations in which the transmission schedule of the program A Voz do Brasil may be made more flexible or even waived by radio stations. Retransmission of the program A Voz do Brasil is mandatory and must be aired daily by radio stations between 7:00 pm and 10:00 pm, except on Saturdays, Sundays and holidays. In 2020, an ordinance opened the possibility of flexibility and waiver of its retransmission in “cases of events of public interest”. To assemble the calendar, the Ministry of Communications conducts annual public consultations, seeking to identify events whose transmission may result in flexibility or even exemption from the retransmission of the program, which is produced by Empresa Brasil de Comunicação (EBC). The public consultation for the 2023 calendar – with the list of dates in which there was a conflict of schedules – ended on January 13th. Among the events that are usually authorized to be made more flexible or not broadcast are traditional festivals; commemorative dates of the municipality; live journalistic coverage of “unpredictable events” and sports. “Exceptionally, the broadcasting of the program A Voz do Brasil may be made more flexible or waived, as the case may be, in the event of events, manifestations or events of great appeal or public repercussion, reported in real time, in view of the absolute impossibility of predicting the fact or event that is the subject of live journalistic coverage,” says the ordinance. Commemorative dates and games “On commemorative dates of the anniversary of Brazilian municipalities, as well as that of the respective patron saints, sound broadcasting stations that wish to transmit actions, events or information related to said commemoration are exempt from retransmitting the program”, defines the ordinance. Flexibilization will be authorized “beyond the originally scheduled times” on days when the Brazilian football team or Brazilian teams are playing, provided that some of the “terms” described are respected. In the case of games scheduled to start between 19:00 and 23:30, the program may be retransmitted, without cuts, starting until 23:00 on the same day. In the case of games scheduled to start after 11:30 pm, the program may be retransmitted, “without cuts, before the game, at the originally scheduled times, or starting up to 11:30 pm on the same day”. A Voz do Brasil retransmission waiver will be authorized if the game that is being broadcast “goes into overtime or results in a penalty shootout decision, preventing its end until the time limit set for the start of retransmission”. The retransmission will also have its waiver authorized in the event of “some force majeure situation during the game that prevents its completion until the time limit set for the start of the retransmission”; as well as in the case of successive games, “that end after 23:30, regardless of intercurrences”. The ordinance emphasizes that, except in cases of waiver, sound broadcasting stations “cannot fail to retransmit the program A Voz do Brasil without express authorization from the Ministry of Communications or outside the waiver dates established in the calendar”.
