Minister Alexandre de Moraes, of the Federal Supreme Court (STF), denied this Wednesday (1st) a defense appeal and kept Anderson Torres, former Minister of Justice and former Secretary of Public Security of the Federal District (DF) in custody. ). Torres was arrested on January 14, upon arrival in Brazil. He was in the United States, where he said he went on vacation a week after taking over as Secretary of Public Security for the Federal District. His departure from the country took place days before the coup acts on January 8, when vandals invaded and destroyed the headquarters of the Three Powers, in Brasília. In a decision this Wednesday, Moraes said it was “absolutely premature to revoke the preventive detention of Anderson Gustavo Torres”. The minister also said that there are pending steps to be carried out by the Federal Police involving the former secretary and former minister of Justice in the Bolsonaro government. The minister again cited the probable omission of Torres, who, even aware of the likelihood of violent acts, would not have taken measures to guarantee the security of Praça dos Três Poderes. Moraes also mentioned that the expertise on the “draft of decree” found during the search and seizure of Torres’ house is still pending. The document provided for the decree of State of Defense on the Superior Electoral Court (TSE) and interruption of the electoral process. The minister said that, in the case of Torres, there is “unequivocally demonstrated evidence of materiality and authorship, even if by participation and willful omission”, with regard to crimes of participation in terrorist acts, including preparatory acts, of attacking public property. and an attempt to abolish the Democratic State of Law and carry out a coup d’état. The Attorney General’s Office (PGR) had spoken out against Torres’ release. Among the arguments is that there has been no change in the situation that led to the arrest of the former secretary. “With regard specifically to the ‘Draft of Decree’, the Attorney General’s Office highlighted the likelihood that, while free, Anderson Gustavo Torres would jeopardize the continuation of investigations, the collection of evidence and, consequently, the prosecution criminal law”, stressed Moraes. Torres’ defense alleges that no criminal act allegedly committed by him has been demonstrated, which is why his preventive detention is not justified. The lawyers added that their client had already provided all the clarifications to the Federal Police, demonstrating that his involvement with the acts of January 8 was not possible. At the Supreme Court, Torres is the subject of a confidential inquiry, in which he is investigated along with the governor removed from the DF, Ibaneis Rocha, and the former commander of the Military Police of the DF Fábio Augusto Vieira.
