Sleeping Giants Brasil, an association of consumers with no economic, political or religious purposes, presented this Wednesday (29) a set of proposals for the future Internet Freedom, Responsibility and Transparency Law. The project is under discussion in the Chamber of Deputies. And despite the 2014 Marco Civil da Internet being a kind of Constitution of the network, for Sleeping Giants, the condition of immunity of the platforms, that is, of exemption from responsibility over the contents, needs to be rethought. That’s what Humberto Ribeiro, Director of Research at Giants explains. “Sleeping Giants considers that the Marco Civil da Internet liability regime should be maintained as a general rule. However, what we have proposed is that the duties of care be incorporated into the new legislative proposal and find a condition for platforms to enjoy of that immunity.” The duty of care establishes that people and companies adopt measures to prevent damage to third parties. Currently, platforms act only when provoked by Justice. And they are only liable if they do not comply with the court order. For Sleeping Giants, the change would make platforms more active in building a more ethical, peaceful, transparent and secure internet. The entity also proposes a single exception to the immunity of platforms, as explained by the Director of Research at Giants. “It would be an exception related to illegal content. Therefore, I mean those defined illegal content in the form of law and international law and for the protection of human rights. It is illegal content that platforms allow to promote, that is, that platforms receive resources to optimize and expand the audience of this content.” For Sleeping Giants, internet regulation needs to focus on the platform’s business model and not on content. This is because in order to use the services, the consumer is obliged to accept the conditions of the platforms without the possibility of negotiation.
