The National Council of Justice (CNJ) determined today (17) the opening of a process to analyze the conduct of the judge Marcelo Malucelli, of the Federal Regional Court of the 4th Region (TRF4), headquartered in Porto Alegre. The request for measures opened by the national justice inspector, Luís Felipe Salomão, intends to determine whether the magistrate failed to comply with the decision of the Federal Supreme Court (STF) that suspended the investigation involving lawyer Rodrigo Tacla Duran, defendant in one of the cases of Operation Lava Jato. The episode began on Thursday (13), when the TRF released information about a decision by Marcelo Malucelli, who would have reinstated Duran’s arrest. However, on Friday (14), the court corrected the information and said that “the decision taken in the partial correction did not decree any arrest”. According to the court, Malucelli only understood that Judge Eduardo Appio, of the 13th Federal Court in Curitiba, who had revoked Duran’s arrest, could not decide on the issue due to the STF injunction that suspended the process. With the CNJ’s decision, Malucelli and Appio will have five days to comment on the issue. Agência Brasil contacted TRF4 and is waiting for a response. Accusations Last month, during a hearing with Eduardo Appio, Tacla Duran said he was the target of persecution for not accepting being extorted during the process in which he is a defendant. Duran said he was contacted by a person who acted as a campaign handler for Senator Sérgio Moro (União-PR) and a lawyer linked to his wife, Rosangela Moro, who would have offered a plea bargain during the investigations. From the mentions, Appio decided to send the case to the Supreme, the court responsible for analyzing issues involving parliamentarians with privileged jurisdiction. After the disclosure of the testimony, Senator Moro said that he does not fear any investigation: “since 2017 [Tacla Duran] makes false accusations, without any proof, save those which he himself fabricated”.
