The Superior Electoral Court (TSE) decided today (2) to maintain the tenure of state deputy Chiara Biondini (PP-MG), elected the youngest parliamentarian in the 2022 elections. which alleged Chiara’s eligibility condition to take office. The deputy contested the inauguration of the deputy, which was held on February 22, after the parliamentarian turned 21, the minimum age required by the Constitution to assume office in the Legislative Assembly of Minas Gerais (ALMG). The other deputies were sworn in on February 1, in the first session of the legislature. According to Chiara’s lawyers, the assembly’s bylaws allow for the inauguration to take place within 30 days after the first meeting. When analyzing the case, unanimously, the ministers of the TSE decided to keep the deputy in office. During the session, the president of the TSE, Minister Alexandre de Moraes, emphasized that the decision is not an authorization for the creation of unreasonable deadlines for deviation of purpose to circumvent the law. In January, Moraes rejected an injunction to prevent Chiara from taking over. “The deadline is not only reasonable, it is customary. It is customary in the National Congress, in the STF and in the entire public service. There is nothing that deviates from regularity”, he concluded.
