The Constitution, Justice and Citizenship Commission (CCJ) of the Chamber of Deputies approved this Tuesday (16) the admissibility of the Proposed Amendment to the Constitution (PEC) 9/23, which provides amnesty for political parties that have not met gender quotas. or race in the 2022 and previous elections or that have irregularities in the rendering of accounts. The CCJ assessed whether the proposal meets the legal requirements. The text goes to a special committee, then to the plenary and, finally, if approved, to the Senate. According to the text approved this Tuesday, the application of fines or suspension of the Party Fund and the Special Campaign Financing Fund to parties that did not have the minimum number of female or black candidates in the 2022 election and previous years is prohibited. Legends are also exempt from punishment for rendering accounts with irregularities before the enactment of the PEC. The proposal authorizes the parties to raise funds with companies to settle debts with suppliers made until August 2015. According to the author of PEC 9/23, deputy Paulo Magalhães (PSD-BA), the proposal is necessary to establish a “framework initial” for the application of sanctions provided for in Constitutional Amendment 117. Approved in 2022, the amendment determined that political parties must allocate at least 30% of the electoral fund to female candidates and black people. Divided opinions Deputy Tarcísio Motta (Psol-RJ) was against the PEC and classified it as “shameful”. “Amnesty not only for the problems that occurred because of the 117th Amendment. It is also shameful because it provided amnesty for all previous elections, all problems of party accountability,” he said. Mota added that the proportion of women in the Brazilian Legislature is lower than in Saudi Arabia, a country that imposes a series of restrictions on women. Deputy Éder Mauro (PL-PA) is in favor of the proposal. For him, Amendment 117 did not obey the principle of annuality. “A change in the electoral process does not apply to elections that take place within one year of its validity.
