The virtual plenary of the Federal Supreme Court (STF) decided to uphold the individual decision of Minister Dias Toffoli who filed a petition filed by President Jair Bolsonaro against Minister Alexandre de Moraes. The decision was taken by majority in a virtual trial, which ended on Friday (2). In May of this year, the president filed a criminal complaint with the Supreme Court and asked for an investigation into Moraes. Through his lawyer, Bolsonaro accused the minister of unjustifiably extending investigations against him, of providing untrue information and of not allowing access to processes. In the same month, the allegations were analyzed by the rapporteur, Minister Dias Toffoli, who rejected the arguments. For the minister, there was no evidence to open an investigation against Moraes. Last week, when analyzing the appeal against the decision, the virtual plenary followed Toffoli’s understanding and denied the appeal. According to most justices, no new arguments were presented that could reform the original decision. “The present appeal proves to be unfeasible, insofar as it only contains the reiteration of the previously exposed defense arguments, without, however, revealing any elements capable of ruling out the reasons expressed in the appealed decision, which must be maintained by its own fundamentals”, voted the rapporteur.
