The National Data Protection Authority (ANPD) created the Digital Governance Committee, which will be responsible for deliberating on how the technical actions aimed at services to be provided digitally by the government will be structured. The idea is to ensure, to users of the Digital Government, the protection of fundamental rights, in order to guarantee freedom, privacy and the “free development of the personality of the natural person, through the protection of personal data”. Linked to the Presidency of the Republic, the ANPD has, among its responsibilities, that of editing rules and supervising procedures for the protection of personal data, as well as applying sanctions. The resolution establishing the entity’s Digital Governance Committee was published on the 25th in the Official Gazette of the Union. Resolution The resolution – which details the committee’s competences and composition – classifies the group established by it as a “permanent body with the purpose of deliberating on matters related to the implementation of digital government actions and the use of information and communication technology resources under the Authority”. The foreseen competences include ensuring the alignment of Information Technology (IT) initiatives to the institutional strategy; deliberate, establish, and monitor IT objectives, goals, plans, projects and actions, as well as define and prioritize IT initiatives and investments; and establish guidelines, standards and practices regarding IT within the scope of the ANPD. The Digital Governance Committee is also responsible for approving IT planning strategies and instruments, which include the Information and Communication Technology Master Plan; the Digital Transformation Plan; and the ANPD Open Data Plan. The group will also be responsible for monitoring and reporting on the execution of IT plans, including the Digital Transformation Plan and the ANPD Open Data Plan; as well as monitoring the performance of actions, compliance with guidelines and the achievement of objectives and goals defined in the Master Plan for Information and Communication Technology. This includes monitoring and evaluating the results obtained with the implementation of IT and digital governance actions. Deliberation In the deliberation made by the ANPD for the creation of the committee, the rapporteur explains that the committee will allow the structuring and proper conduction of the programs, policies and IT projects of the ANPD. “The performance of information technology arises in order to reduce operational risks and guarantee the continuity of public services offered to society”, detailed the report. “And the Digital Governance Committee comes to boost the role of top management in governance on the optimization of IT resources, adding value to organizations”, he added. The institution of the committee is, according to the ANPD, “in line with the Digital Government Strategy to be observed by bodies and entities of the direct federal, autonomous and foundational public administration for the period from 2020 to 2023, as defined in Decree No. of April 28, 2020”.
