The President of the Superior Court of Justice (STJ), Minister Maria Thereza de Assis Moura, determined, this Wednesday (1st), to quote Ricardo Falco, friend of the player Robinho, in the process in which the Italian government asks for approval sentence that sentenced him to nine years in prison for the crime of collective rape. Homologation by the STJ is a condition for the decision of the Italian Court to be enforced in Brazil. Both were sentenced in Italy to the same sentence, for the same crime. In the STJ, the procedures for homologation of the sentence are the same. As with Robinho on the 23rd, the minister summoned the Attorney General’s Office (PGR) to indicate an address where Falco can be summoned. “In this Wednesday’s decision, the magistrate noted that, in a preliminary examination, the request for approval meets the legal requirements set forth in article 216-D of the Internal Regulations of the STJ”, says the court. After the summons, if the defense objects to Italy’s request, the case will be assigned to a rapporteur belonging to the Special Court. When there is no contestation, the attribution of ratifying a foreign judgment rests with the presidency of the court. The crime was committed in 2013 in a nightclub in the city of Milan.
