Minister Maria Thereza de Assis Moura, president of the Superior Court of Justice (STJ), determined the immediate citation of former soccer player Robinho, so that he becomes aware of the process in which Italy seeks his arrest in Brazil. The citation is the legal act in which an interested party is summoned to participate in the process. The Brazilian was convicted in three instances of the Italian Justice for his involvement in a collective rape, inside a Milan nightclub, which occurred in 2013. In February, the president of the STJ heard a request from the Italian State and proceeded with the process. She referred the case to the Attorney General’s Office (PGR), the prosecuting body, and now cites Robinho. This is the second attempt to quote Robinho, after he was not found at a first address. After the defense informed where the former player should be found, Minister Assis Moura ordered new compliance with the measure. The PGR has already manifested itself in favor of the progress of the judgment recognition process in Brazil. In the opinion, signed by the Deputy Attorney General of the Republic Carlos Frederico Santos, the body said that “there are no restrictions on the transfer of the execution of the sentence imposed on Brazilians born abroad”. Italy had requested Robinho’s extradition. The Brazilian Constitution, however, does not provide for the possibility of extradition of natural-born citizens. For this reason, the European country decided to request the transfer of the former player’s sentence. After Robinho’s citation, his defense may challenge Italy’s request. If this occurs, the case must be distributed, by lot, to a rapporteur at the STJ, who will be responsible for moving forward with the process.
