Minister Nunes Marques, of the Federal Supreme Court (STF), determined today (20) that the President of the Chamber of Deputies, Arthur Lira (PP-AL), provide information on the processing of provisional measures. The decision was motivated by an action filed last week by Senator Alessandro Vieira (PSDB-SE) to force Lira to designate the joint committees to analyze provisional measures, a rite that was suspended during the covid-19 pandemic and allowed the voting of the matters directly on the floor of the House and Senate. The minister’s determination aims to obtain Arthur Lira’s manifestation before judging the issue. The Advocacy General of the Union (AGU) and the Attorney General of the Republic (PGR) should also comment on the issue. There is no deadline for the final decision. In the action, Vieira intends that the Supreme suspend the joint act of the Chamber and the Senate that, in March 2020, made the rules of procedure more flexible. Last month, another joint act by the boards of directors of the two Houses defined the return to the ordinary regime and the duty to create committees to analyze matters. However, according to the senator, the measure is not being fulfilled by Lira. According to the parliamentarian, maintaining the model gives extraordinary powers to the President of the House, who can define the rapporteurs of the MPs, in addition to sending the matter to the Senate on the eve of the expiry date. “Since the approval of the act also depends on the expression of will of the President of the Chamber of Deputies, now a coercive authority, Mr. Arthur Lira remained inert, refusing to sign the proposal on behalf of the Board of Directors of the Chamber, insofar as he intends that the examination of the provisional measures continue indefinitely in the current manner”, argued the senator. MPs Provisional Measures (MPs) are norms with the force of law, sent by the President of the Republic for analysis by the National Congress. The rule is that the MP is edited in situations of relevance and urgency. As soon as it is edited, the MP already produces immediate legal effect. However, to become law, it needs to be approved by the Chamber of Deputies and the Senate. The term of validity of the MP is 60 days, automatically extended for an equal period if the vote in Congress has not been concluded.
