STF resumes trial that could annul decree pardoning deputy

The Federal Supreme Court (STF) resumed, this Thursday (4), the judgment on the legality of the pardon granted last year by then-president Jair Bolsonaro to Daniel Silveira, at the time a federal deputy for Rio de Janeiro. Since last week, four lawsuits filed by political parties against the benefit have been judged. In yesterday’s session (3), the President of the Court and rapporteur for the cases, Minister Rosa Weber, voted for the annulment of the decree, on the understanding that Bolsonaro’s act was done with a deviation of purpose. For Rosa Weber, the measure revealed “an authoritarian and non-compliant facet of the Constitution”. “The President of the Republic issued a decree of individual pardon absolutely disconnected from the public interest. The truth is that the desired end with the issuance of the pardon decree was to benefit a first-time political ally, legitimately condemned by the STF”, said the minister. In this afternoon’s session, the judgment, which is on its third day, was resumed with the vote of Minister André Mendonça. Eight more ministers are expected to vote. In May of last year, Bolsonaro signed a decree granting constitutional grace to the sentence of former federal deputy Daniel Silveira (PTB-RJ), a supporter of the then president and a member of his base in the Chamber of Deputies. The decree was issued on April 21, one day after the parliamentarian was sentenced by the Supreme Court to 8 years and 9 months in prison for the crimes of trying to prevent the free exercise of powers and coercion in the course of the process to which he responds for attacks on the Cut. In February, after leaving the parliamentary mandate, Silveira was arrested for failing to comply with house arrest rules and making new attacks on the Supreme Court.
