The majority of the ministers of the Federal Supreme Court (STF) voted to make defendants over 131 denounced for their participation in the coup acts of January 8, when the headquarters of the Three Powers of the Republic, in Brasília, were invaded and vandalized by supporters of the former president Jair Bolsonaro. With that, they reach 1,176 open criminal actions against people involved in the episode. So far, none of the 1,390 formal charges filed by the Attorney General’s Office (PGR) have been rejected. Analysis on whether or not the remaining 214 complaints were received has yet to be scheduled. In this most recent batch of complaints, the main accusation, in all cases, is that of inciting the animosity of the Armed Forces against constituted power and of criminal association. The denunciations target people trapped in the camp set up in front of the Army Headquarters, in Brasília, the day after the attacks. Receipts of complaints are being judged in the virtual plenary, in which ministers have a window of time to vote remotely, without in-person deliberation. The analysis of this sixth group of complaints is scheduled to last until 23:59 this Monday (29). So far, the rapporteur, Minister Alexandre de Moraes, and Ministers Dias Toffoil, Cármen Lúcia, Gilmar Mendes, Rosa Weber and Edson Fachin have voted to receive this new wave. As in previous times, ministers André Mendonça and Nunes Marques diverged. The votes of Luís Roberto Barroso and Luiz Fux are still missing. With the receipt of the complaint and the opening of criminal proceedings, a new phase of investigation of the process begins, in which defense and prosecution witnesses are heard, for example. It is only at the end of this stage that the STF should judge, on a case-by-case basis, any conviction of the defendants. There is no deadline for this to occur. Of the total complaints already received, 225 concern people accused of direct participation in attacks on public buildings. In this case, they are accused of crimes such as attempted violent abolition of the Democratic State of Law, coup d’état and depredation of protected public property, among others. All judgments on whether or not the denouncements were received are being carried out within two investigations, which target inciters and perpetrators of coup acts, respectively. There are at least two more inquiries at the Supreme Court related to January 8, which target possible financiers and authorities suspected of failing to deal with the attacks. Ahead of the investigations, the PGR has not yet filed complaints in these processes, which are still under investigation by the Federal Police (PF), in the operation called Lesa Pátria.
