Chamber formalizes TSE decision and declares Deltan’s mandate loss

The Chamber of Deputies declared this Tuesday (6) the loss of mandate of Deputy Deltan Dallagnol (Podemos-PR). On May 16, the Superior Electoral Court (TSE) unanimously revoked the deputy’s mandate on the understanding that Deltan Dallagnol asked for his resignation from the position of public prosecutor while administrative processes were being processed that could make him ineligible, if convicted. According to the Chamber of Deputies, the appointment of the substitute is pending, due to a dispute between Itamar Paim (PL) and Luiz Carlos Hauly (Podemos). The appointment will be determined by decision of the Court. The appointment of the alternate who will occupy Dallagnol’s chair still depends on a court decision, as there is a dispute between Itamar Paim (PL) and Luiz Carlos Hauly (Podemos). In an official note, the Chamber explains that, in case of loss of mandate determined by the Electoral Justice, it is up to the Board of Directors of the House to declare the loss and formalize the decision of the Electoral Justice. “In this case, there is no need to speak of a decision by the Chamber of Deputies, but only a declaration of loss of mandate by the Board”, says the note. The other situations in which a deputy may have his mandate revoked are breach of decorum or a final criminal conviction, when the loss is decided by an absolute majority of the Plenary of the Chamber of Deputies.
