The Federal Supreme Court (STF) formed a majority of votes to transform into defendants 100 denounced by the Attorney General’s Office (PGR) for the coup acts of January 8. On that occasion, the headquarters of the Federal Supreme Court, the National Congress and the Planalto Palace were vandalized. Six ministers voted in favor of receiving the complaints. So far, the vote of rapporteur Alexandres de Moraes has been accompanied by ministers Luís Roberto Barroso, Gilmar Mendes, Dias Toffoli, Edson Fachin and Cármen Lúcia. The virtual vote against the accused began at midnight on the 18th, Tuesday, and runs until 23:59 on Monday (24). When presenting his vote, Alexandre de Moraes described as “extremely serious” the conduct of the defendants, who had as their ultimate objective to abolish the powers of the State. The ministers who still need to present their votes in the electronic system are André Mendonça, Nunes Marques, Rosa Weber and Luiz Fux. With the beginning of the process, there will be collection of evidence and testimonies of defense and prosecution witnesses. Afterwards, the STF will still have to decide whether to condemn or acquit the accused, which does not have a deadline to occur. The complaints involve crimes provided for in the Penal Code: criminal association; violent abolition of the democratic rule of law; coup d’etat; threat; persecution; incitement to crime and qualified damage. The PGR also cites the crime of deterioration of listed heritage. A STF survey shows that of the 1,400 people arrested on the day of the attacks, 294 remain in the Federal District penitentiary system. The others were released because they no longer represented a risk to society and investigations.
