Minister Rosa Weber, president of the Federal Supreme Court (STF), cast the eighth vote to transform another 200 defendants into defendants in the investigation into the coup acts of January 8, when the headquarters of the Three Powers were invaded and largely depredated by supporters of the former president Jair Bolsonaro. Rosa Weber fully accompanied the vote of the rapporteur of the inquiries into the case at the Supreme Court, Minister Alexandre de Moraes. Ministers Gilmar Mendes, Luís Roberto Barroso, Edson Fachin, Cármen Lúcia, Luiz Fux and Dias Toffoli also accompanied him. Only the votes of André Mendonça and Nunes Marques remain. The receipt or not of these 200 complaints is being judged in a virtual plenary, in which votes are deposited electronically, without in-person deliberation. The session started on Tuesday (25) and continues until 23:59 on the next Tuesday (2). With the majority formed, after the end of the trial the accused will respond to a criminal action and become defendants in the process. At this stage, Moraes must analyze the maintenance of preventive detention of the accused who are still being held. Steps A first batch of 100 complaints was accepted last week, by 8 votes to 2. At the time, only Mendonça and Marques disagreed with the others. They were the only ones who defended that the complaints should be judged by the first instance of Federal Justice. In his vote, Marques also relativized the responsibility of people arrested in the camp in front of the Army Headquarters, in Brasília. The minister pondered that not all of them committed crimes, and that a deeper analysis of the conduct of each one would be needed so that accusations against them could be accepted. On the other hand, in this week’s vote, already followed by the majority of the Supreme Court, Moraes pointed out that those involved in the acts of January 8 tried to “destroy the democratic regime and its institutions, preaching violence, pleading tyranny, arbitrariness, violence and the breach of republican principles”. A new wave of 250 complaints is scheduled to be judged next week, in a virtual session scheduled to start at midnight next Wednesday (3). Volume of cases In all, the Attorney General’s Office (PGR) filed 1,390 formal accusations to the Supreme Court, all against people who directly participated in acts of vandalism or who incited violence. So far, no one has been denounced for financing or idealizing coup acts. The situation is unprecedented for the Supreme Court, which had never dealt with so many simultaneous complaints about the same case. Virtual sessions were the way found by Moraes and the President of the Supreme Court, Rosa Weber, to deal with such a large volume of people prosecuted. The measure, however, has been criticized by lawyers. The forecast is that the possible receipt of all complaints will be appreciated by June. Then, the criminal action phase should begin, with a new procedural instruction and possible production of new evidence and collection of new testimonies, even at the request of the defenses. There is no set deadline for the final judgment.
