The Military Court of Justice of São Paulo (TJMSP) determined, this Thursday (2), that the soldier of the Military Police (PM) João Paulo Servato, who attacked and stepped on the neck of a woman in Parelheiros, in São Paulo, serve the sentence openly. Last Tuesday (31), Servato was sentenced in second instance to serve one year, eight months and 12 days in prison, but the court had not yet decided how the sentence would be served. The Court’s judgment also determined an open regime for serving the sentence of PM corporal Ricardo de Morais Lopes, who participated in the aggression, was convicted of ideological falsehood. The penalty applied to the corporal was one year, two months and 12 days in prison. “The fixed regime is open, with the conditional suspension of the sentence being granted based on article 606 of the CPPM for a period of 2 (two) years, without special conditions, in addition to the generic ones provided for in article 626 of the same Code, with the exception of the provision in paragraph “c” of this article, considering the need for the appellants to carry weapons due to their functional condition”, details an excerpt from the judgment of the First Chamber of the TJMSP. The conviction of the two police officers reverses the lower court decision that had acquitted the police officers for the crime. The Public Ministry appealed against the acquittal and the court decided to condemn the military. In a note, the police defense lawyer, João Carlos Campanini, informed that he will appeal the decision. Agência Brasil tried to contact the victim’s lawyer, Felipe Morandini, and is awaiting a response. About the crime At the time of the crime, the victim owned a bar in the community of Parelheiros, in the south of São Paulo, which would be open, contrary to the restrictions adopted during the covid-19 pandemic. The woman even had her neck stepped on by Servato, as revealed by images published in the mainstream press. The images also showed the officer dragging the woman for a few meters, until he released her on the sidewalk. The victim said she had fainted four times, due to asphyxiation, and that the police had also thrown three punches at her, causing her tibia (a bone located in the lower part of her leg) to fracture. Police officers went to the address after being called by neighbors of the woman’s bar, who were bothered by the high volume of sound emitted by the car of a customer of the establishment. The woman said that the violence began when she intervened in defense of a friend, who was immobilized by them and hit with knees.
